Heard learned counsel appearing for the parties. 3. Learned counsel appearing for the Petitioner files the memo containing letter dt.23.02.2024 so submitted before Opp. Party No.4. The same be kept on record. 4. The present Writ Petition has been filed inter alia with the following prayer: Hon'ble Court may graciously be pleased to issue a writ in the nature of Mandamus or any other appropriate writ/order/direction, quashing the illegal and unwarranted query raised by the Opposite Parties regarding submission of a wife's death certificate and adoption certificate of a son, the same being contrary to record and unsustainable in law, and further be pleased to direct the Opposite Parties to forthwith process and finalize the petitioner's pension papers and release his lawful retiral dues, including pension, gratuity and all consequential financial benefits, within a time frame as may be fixed by this Hon'ble Court; And such other relief or relief(s) as this Hon'ble Court deems just and proper in the facts and circumstances of the case may also be granted. And for this act of kindness the petitioner shall as in duty bound pray for ever. 5. It is contended that even though Petitioner has retired from his services on attaining the age of superannuation on 31.07.2021, but when his pensionary benefits were not released, the present Writ Petition was filed with the aforesaid prayer. 5.1. It is further contended that on the instructions so provided by Opp. party No.4 vide his letter dt.06.02.2026, when Petitioner came to know that because of the wrong committed by him in indicating the nephew of the Petitioner as a nominee, such pension papers have not yet been submitted, Petitioner vide letter dt.23.02.2026 has already requested Opp. party No.4 to delete the nominee from the pension paper and re-submit the same. 6. Learned Addl. Govt. Advocate taking into account the letter submitted before Opp. party No.4 on 23.02.2026 contended that appropriate order can be passed directing Opp. party No.4 to submit the pension paper by deleting the name of the nominee so made by the Petitioner while submitting the pension papers. 7. Having heard learned counsel appearing for the parties, considering the submission made, this Court while disposing the Writ Petition directs Opp. party No.4 to submit the pension papers of the Petitioner, taking into account the letter submitted by him on 23.02.2026. 7.1. However, for the said purpose, Petitioner is directed to appear before Opp. Party No.4 on or before 20th March, 2026. On his appearance and on deletion of the name of the nominee, pension papers be submitted before the appropriate authority without any further delay. 8.
