This criminal miscellaneous petition has been filed under Section 528 of B.N.S.S. by the petitioner with a prayer for modification of the order dated 10.04.2024 passed in A.B.A. No.3961 of 2023 for extension of time to surrender before the court. 3. Learned counsel for the petitioner has submitted that vide order dated 10.04.2024 passed in A.B.A. No.3961 of 2023, the petitioner was given the privilege of anticipatory bail by this Court and was directed to surrender before the court below within four weeks. It is further submitted that petitioner could not furnish his bail bond before the court below within stipulated period of time due to some medical issue as mentioned at paragraph Nos.6 and 7. It is further submitted that there is no deliberate inaction or lapse on the part of petitioner. Hence, the time period for the petitioner to surrender before the court below in terms of the order dated 10.04.2024 passed in A.B.A. No.3961 of 2023 may be extended. 4. Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for extension of the time for the petitioner to surrender in the court below in terms of the order dated 10.04.2024 passed in A.B.A. No.3961 of 2023 is allowed. Hence, the petitioner is directed to surrender before the court below “within two weeks from 2025:JHHC:12417 2 the date of receipt of the copy of this order in terms of the order dated 10.04.2024 passed in A.B.A. No.3961 of 2023”. 5. The order dated 10.04.2024 passed in A.B.A. No.3961 of 2023 is modified to the aforesaid extent. 6. Accordingly, this criminal miscellaneous petition is disposed off. (Pradeep Kumar Srivastava, J.)
