Counsel of both sides. Ld. Counsel Ms. S. Das has again prayed for time to submit Counter Affidavit which is rejected. On 2 occasions earlier, adjournments were granted to the respondent to submit affidavit in opposition. Therefore, prayer of adjournment stands rejected. Heard both sides on the merit of the petition. The respondent has filed a suit for restitution of conjugal right bearing No.T.S.(RCR) 04 of 2025 in the Court of Ld. Addl. District & Sessions Judge, Bishalgarh, Sepahijala, against the petitioner. It is the assertion of the petitioner that she is now posted at Khowai as District Coordinator under Tripura Rural Livelihood Mission(TRLM) and she is residing at Badharghat, Agartala and -2- therefore, for convenience of both sides, said case may be transferred to the Court of Ld. Judge, Family Court, Agartala, West Tripura. Ld. Counsel of the petitioner submits that it is only a half an hour journey to come from Bishalgarh to Agartala and therefore, it will not cause any inconvenience to the respondent to attend the Court at Agartala to contest the case. Ld. Counsel of the respondent, however, submits that the respondent is working as a teacher in a private institute at Bishalgarh and therefore, it may be inconvenient for him to come to Agartala to attend the Court. It appears from the submission of both sides that the present place of posting of the petitioner is at Khowai and the present place of posting of the respondent is at Bishalgarh. Bishalgarh is located at a very short distance from Agartala and therefore, it will not be much inconvenience for the respondent to attend and contest the case coming to Agartala. The petitioner is also residing at Agartala. Considering convenience of both sides, the petition is allowed. The case bearing No. T.S (RCR) 04 of 2025 is withdrawn from the Court of Ld. Addl. District Judge, Bishalgarh and transferred to the Court of Ld. Judge, Family Court, Agartala, West Tripura for disposal in accordance with law. Ld. Addl. District Judge, Bishalgarh will send the record immediately to the Court of Ld. Judge, Family Court, Agartala, West Tripura. A copy of this order be sent to the Court of both Ld. Addl. District Judge, Bishalgarh and Ld. Judge, Family Court, Agartala for compliance. This petition is accordingly disposed of. Stay order(s), if any, shall also stand vacated.
