Heard the parties.
The petitioner has been made accused in connection with Ranka P.S. Case No. 176 of 2023, S.T. Case No.76 of 2024, for the offence under Sections 147, 148, 341, 323, 149, 307, 302, 504 & 506 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional Sessions Judge-III, Garhwa.
On 24.10.2023, petitioner alongwith co-accused persons came to the house of the informant. The accused persons started assaulting the family members of the informant. It is alleged that petitioner had shot Malti Devi. It is further alleged that the father of the petitioner also inflicted Axe injury on her, due to which, she succumbed to her injuries.
Learned senior counsel for the petitioner submitted that the deceased apart from firearm injuries also sustained lacerated and sharp cutting injuries on her person. It cannot be said that the firearm injury had led to her death. It was also submitted that there is property dispute between the parties and the occurrence was not premediated.
Learned A.P.P on behalf of the State has opposed the prayer for bail and submitted that out of 19 chargesheet witnesses, nine have already been examined.
Considering the nature of allegation and the fact that the trial is in progress, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is rejected.
Learned Trial Court shall expedite the trial.
