THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER
In this petition, petitioners seek the following reliefs:
“(i) To set aside and stay the order dated 31.05.2025 passed in Crl.Misc.No.1012/2024 by the Hon’ble 2nd Addl. Chief Judicial Magistrate at Bangalore Rural, Bangalore by directing the petitioner to accommodate the respondent to reside along with them to reside in the shared house. (ii) To call for the records from the Court below in Crl.Mis.No.1012/2024 by the Hon’ble 2nd Addl. Chief Judicial Magistrate at Bangalore Rural, Bangalore. (iii) To grant any other reliefs as this Hon’ble Court deems fit in the interest of justice and equity.”
2. Heard learned counsel for the petitioners and learned counsel for the respondent and perused the material on record. 3.
Though several contentions have been urged by both sides in support of their respective claims having regard to

availability of equally efficacious and alternate remedy by way of an appeal before the Sessions Court under Section 29 of Protection of Women from Domestic Violence Act, petition stands disposed of reserving liberty in favour of the petitioners to file an appropriate appeal, which shall be considered by the Sessions Court, in accordance with law. It is made clear that the appeal in Crl.A.No.65/2025 already filed by the petitioners, which stands withdrawn as on today will not come in the way of the petitioners filing a fresh appeal and Sessions Court considering the same on merits, in accordance with law. 4.
