BEFORE HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI ORDER 13.12.2025 This is an appeal filed by the claimant-appellant against the Award dated 03.11.2016 passed by the learned Member, Motor Accident Claims Tribunal, Goalpara (for short MACT, Goalpara) in MAC Case No. 170/2014. Ms. Hena Haflongbar, Assistant Manager of The New India Insurance Assurance Company Ltd. (Insurance Company); Shri R.K.K. Sinha, Regional Manager of the Oriental Insurance Company Ltd. (for short Insurance Company) and the claimant-Ms. Kabita Narzary @ Boro along with her learned counsel, Shri A.R. Agarwala are present today i.e., 13.12.2025 in the National Lok Adalat. It is submitted that the earlier Award has already been deposited but not withdrawn. The parties present jointly submit that the matter has been amicably settled between the parties and an additional amount Rs. 9,60,000/- (Rupees Nine lakhs sixty thousand) only as full and final settlement has been agreed upon. Page No.# 3/3 In view of the above, the appeal stands closed with a direction that an amount of Rs. 4,80,000/- (Rupees Four lakhs eighty thousand) only, each shall be deposited by both the Insurance Companies being the full and final payment before the MACT, Goalpara within a period of 45 days from today.
The claimant-Ms. Kabita Narzary @ Boro would be at liberty to withdraw the entire amount on being properly identified by her learned counsel. The MAC appeal accordingly stands disposed of. Send back the TCRs, if any. JUDGE Comparing Assistant
