JUSTICE SATYAVRAT VERMA ORAL ORDER 3 15-05-2025 1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 279, 379, 354, 307, 504, 506, 337 and 338 of IPC. 3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 14-10-2020, accused Rahmt Alam came driving a tractor and dashed his cousin brother and when the informant objected, Rehmt Alam started abusing him, thereafter other accused persons reached the place of occurrence and Nasim ordered to kill the informant, thereafter Salim dashed the Patna High Court CR. No.19396 of 2025(3) dt.15-05-2025 2/3 informant while Asif and Nasim wrapped towel around his neck and dragged him with an intention to kill, thereafter all the accused assaulted the informant with lathi, danda and rod, on account of which, he sustained injury, and when aunt of the informant came to save him, Fariyad and Vasim assaulted her and also tore her clothes and Naushad snatched golden chain. 4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegation of assault against the petitioners is not specific rather is general and omnibus in nature. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners. 6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kundwa Patna High Court CR.
