Petitioner has filed this petition under Section 483 BNSS for grant of regular bail in FIR No.494, dated 10.12.2024, under Sections 96, 316(2), 351(3) & 61(2) BNS and Sections 4, 18 and 17 of POCSO Act (Section 115 of BNS has been deleted during investigation), registered at Police Station Kheripul, District Faridabad.
2. As per facts of the case, the complainant i.e. father of the victim gave his statement that his daughter i.e. victim ‘T’ age about 16 years was doing 10th standard from Open School. In the month of February 2024, she developed friendship with Sukhi Bhati through Instagram and they started talking to each other. Said Sukhi Bhati visited Faridabad and gave one mobile phone to his daughter which was returned back. He used to come time and again to meet his daughter in a temple near Govt. School Budena. 2 ornaments by enticing her. On 29.10.2024, Sukhi Bhati called his daughter in front of temple near Govt. School and he suggested to accompany him to OYO but she refused. Sukhi Bhati called his two friends who came in a white coloured car namely Ritik and Golu. Sukhi Bhati gave beating to his daughter and forcibly took her to OYO situated near Sabji Mandi, Balabgarh. Said Sukhi Bhati tried to commit rape forcibly with her while Ritik and Golu stayed outside the OYO. Thereafter, the victim was dropped near Govt. School, Budena and all the three accused left.

Learned counsel for the petitioner argued that he is falsely implicated in this case. There are no allegations of rape against him. He was arrested on 11.12.2024. Now, the alleged victim has given statement before Additional Sessions Judge, Fast Track Special Court, Faridabad on 24.12.2024 (Annexure P-2) and another statement on 05.02.2025 (Annexure P-3) confirming that present petitioner has not done anything. In fact, the victim was in contact with Sukhi Bhati through social media platform. He is ready to abide by the terms of bail order, therefore, his regular bail application may be allowed.
4. Status report filed, which is taken on record. As per the status report, it is pointed out that as per CCTV footage present petitioner was clearly visible accompanying the victim at OYO Hotel and he was found standing outside. It is confirmed that challan has been presented on 27.01.2025 and the case is fixed for consideration on charge.
5. Ms. Tanya Vashist, Advocate, appeared and filed Vakalatnama on behalf of the complainant. The same is taken on record. The complainant/prosecutrix as well as the alleged victim through said MONIKA RANI counsel did not oppose the regular bail application filed by the petitioner. 2025.04.03 11:06 I attest to the accuracy and integrity of this document

6. I have considered the arguments and have gone through the record. Petitioner- Lalit Sharma has already joined the investigation on 11.12.2024 and at present he is in judicial lockup. Even, challan has been presented. The victim gave her statement before the Court on two occasions leveling no allegations against the petitioner. Trial in this case is likely to take time which is at initial stage. No purpose would be served by keeping him behind the bars for indefinite time period. In the light of this, without expressing my mind on the merits of the case, regular bail petition filed by the petitioner – Lalit Sharma @ Ritik is allowed. He is ordered to be released on bail on furnishing bail bonds and surety bonds to the satisfaction of trial Court/Duty Judge concerned.
7. Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
