Also heard Mr. Y. Riram, learned Government Advocate appearing for respondent Nos. 1 to 4 and Mr. M. Kato, learned DSGI appearing for respondent Nos. 5 to 8. 3. The pleaded case of the petitioners is that on 27.04.2021, the Government of Arunachal Pradesh, Department of Land Management, Itanagar, issued a notification under Section 10 of the Balipara/Tirap/Sadiya Frontier Tract Jhum Land Regulation, 1947, vide No. LM-212/ACQ/2021. The further case of the petitioners is that the Deputy Commissioner, Anjaw District, vide letter No. ANJ/LM-83/2018-19/1521-49 dated 13.07.2020, notified for the conduct of land survey and property assessment for the widening/improvement of the existing defence road to NHDL specification in respect of the Changwinti–Namti stretch from KM 00.00 to 45.450, for construction of a defence road by GREF. 4. The petitioners are aggrieved by the fact that, while making the Page No.# 16/17 assessment, certain horticultural, agricultural and other standing assets were not taken into consideration. Therefore, they filed a representation before the respondent authorities; however, the said representation has not been disposed of by the Deputy Commissioner, Anjaw District till date. 5. Being aggrieved, the petitioners have filed the present writ petition seeking a direction to the respondent authorities to consider their case for re-survey and inclusion of the horticultural, agricultural and other standing assets along the Changwinti–Namti stretch from KM 00.00 to 45.450, in connection with the construction and widening/improvement of the existing defence road to NHDL specifications by GREF. 6. The respondent Government has filed an affidavit-in-opposition contending that there is no error in the assessment of horticultural, agricultural and structural assets; however, it is stated that some properties were assessed but not compensated as per the board parameters for the land acquisition process issued by the competent authorities. 7. However, at this stage, Mr. Das, learned Senior Counsel, for the petitioners submits that since the representation submitted by the writ petitioners is pending disposal before the respondent No. 4, i.e., the Deputy Commissioner, Anjaw District, this writ petition may be disposed of by directing the said authority to dispose of the representation, dated 30.12.2024, for re- survey and inclusion of the petitioners’ land allegedly taken by the respondent authorities along the Changwinti–Namti road. 8. Learned counsel appearing for the respondents submits that they have no objection to the prayer of the writ petitioners to the extent that the writ petition is disposed of with a direction to the respondent authorities to dispose of the Page No.# 17/17 representation submitted by the petitioners, dated 30.12.2024, in accordance with law by giving sufficient time for doing so. 9. Considering the limited prayer made by the learned Senior Counsel for the petitioners and as agreed upon by the learned counsel for the respondents, this writ petition is disposed of with a direction to the Deputy Commissioner, Anjaw District/respondent No. 4 to consider and dispose of the representation dated 30.12.2024 submitted by the writ petitioners, 72 in number, for re-survey and inclusion of horticultural, agricultural and other standing assets along the Changwinti–Namti road, after affording an opportunity of hearing to the parties, in accordance with law, within a period of 45 days from the date of receipt of a certified copy of this order to be submitted by the petitioners. 10. The Deputy Commissioner, Anjaw District, may constitute a committee, including five (5) members representatives from amongst the petitioners as well as any other persons whom the Deputy Commissioner may deems fit, for proper disposal of the representation submitted by the petitioners. 11.
