This Court is of the view that the said Application need not be ordered for the reason that the present Suit is a Suit under Section 92 CPC in which if the Plaintiffs who had instituted the Suit are not effectively prosecuting, the defendants who had impleaded https://www.mhc.tn.gov.in/judis themselves or any other person interested in the Suit can continue to prosecute the Suit. It is claim of the applicant that the plaintiffs herein are not effectively contesting the Suit. The Court deals with the Suit under Section 92 CPC as a parens patriae jurisdiction. When that being the case, even if the defendant alleges that mal- administration or misfeasence in the administration of the Trust, this Court can only in the interest of justice pass appropriate orders as required for better administration of the Trust. Since the applicant who had been impleaded as defendant has also filed his written statement and is effectively contesting the Suit, there is no necessity to now transpose the applicant.
