1. Heard Mr. Singha, learned counsel for the petitioner. Also heard Ms. R J Baruah, learned Additional Public Prosecutor for the State of Assam. 2. The petitioner, Imranul Latif Baruah is seeking anticipatory bail in connection with North Lakhimpur P.S. Case No.265/2025, under Sections
Page No.# 2/3 61(2)/316(2)/318(4)/340(2) of the BNS, 2023. 3. The FIR has been lodged by Ivy Baruah on 30.07.2025 stated to be a relative of the petitioner. In the FIR, the informant has alleged that the present accused petitioner in connivance with one named land broker and possibly another Revenue Official illegally sold her land 3 kathas (Patta No.37, Dag No.140) and another 1 katha (Patta No.37, Dag No.243) for an amount of Rs.80,00,000/-, without obtaining her NOC and from other pattadars of the family. 4. It is also alleged that the petitioner and others for the purposes of sale submitted the fake No Objection Certificate(NOC) with forged signatures to execute the sale deed. 5. Learned counsel has taken the Court through the series of copies of Revenue documents annexed with the Bail petition and has contended that both the petitioner and the informant are sharers of the ancestral land and that the land which was allegedly a subject matter of the same, falls in a different dag for which NOC of the informant is not necessary. 6. It is submitted that the allegation of the petitioner forging a No Objection Certificate(NOC) and signature is completely false. 7. On the other hand, the learned Additional Public Prosecutor Mr. R J Baruah, with reference to the case diary, submitted that the petitioner obtained the certificate from the concerned Gaonburah, wherein a person who was alive
Page No.# 3/3 has been certified as dead and also forged the signature of another person. 8.
Upon perusal of the case diary, including the statement of the accused himself, there appears to be sufficient incriminating material against the petitioner for which his custodial interrogation may be necessary. 9. In view of above, the prayer for bail stands rejected and the order of interim pre-arrest bail dated 17.09.2025 stands vacated. 10. Petition stands dismissed. 11. Send back the LCR.
