PP, Assam. 2. By this application, the petitioner, namely, Harsh Sharma, has prayed for bail in connection with Dispur P.S. Case No. 639/2025 registered under Sections 316(2)/318(4) of BNS, 2023. The allegation as disclosed in the FIR is that a vehicle was given to one Manish Jyoti Das for the purpose of self-drive rented car business by the informant and during the course of the said business, the informant found that the vehicle was stolen and during the inquiry it was found that the vehicle was misappropriated and sold out to some other person. 4. It is submitted by the learned counsel for the petitioner that there is no involvement of the present accused and the co-accused, namely, Shibjit Sharma, has already been granted bail by the learned Addl. Sessions Judge No. 2, Kamrup (M), by order dated 17.10.2025 in BA 958/2025. Further, this Court has also granted bail to another co-accused, namely, Sima Sharma, by order dated 26.09.2025 in BA 3204/2025. 5. The Forwarding report in respect of the present petitioner has been furnished by the learned counsel for the petitioner, which is kept on record. On perusal of the same, it appears that the present petitioner has been arrested upon being implicated by a co-accused and no other material is indicated in the case diary and no recovery was made from the present accused. 6. Having regard to the above as well as the fact that the co-accused have already been granted bail and also considering the progress of investigation and the period of detention, which, in the case of the present petitioner, is 38 days, the prayer for bail is allowed. 7. Accordingly, the accused petitioner, named above, shall be released on bail of Rs.50,000/-, with one surety of like amount to the satisfaction of the Eleka Magistrate, subject to the following conditions:- 1) The petitioner shall cooperate with the investigation and shall appear before the learned Trial Court as and when called for.
