Memo of proof of service as also been filed submitting that the order dated 23.09.2024 permitting the petitioner to learned counsel for the respondent before Trial Court, he has been served. Being aggrieved from the order dated 18.06.2024 in I.A.No.437 of 2023 in OS.No.320 of 2015 on the file of I Additional Civil Judge (Senior Division), Vijayawada, the petitioner has filed this petition under Article Constitution of India. pursuant to serve the notice on 4. 227 of 6. The petitioner is the defendant in the said suit. He filed the said application under Section 340 R/w. 195 of Cr.P.C. to initiate the contempt proceedings against the plaintiffs in OS.No.320 of 2015. Those plaintiffs the present respondent Nos.1 to 4. The application has been dismissed learned Court of I Additional Civil Judge (Senior Division), Vijayawada 7. Section 341 of the Code of Criminal Procedure, 1973 (in short reads as under: are by the CrPC”) "341. Appeal- (1) Any person on whose application any Court other than a High Court has refused to make a complaint under sub-section (1) or sub-section (2) of Section 340, or against whom such a complaint has been made by such Court, may appeai to the Court to which such former Court is subordinate within the meaning of sub-section (4) of Section 195, and the superior Court may thereupon, after notice to the parties concerned, direct the withdrawal of the complaint or, as the case may be, making of the complaint which such former Court might have made under Section 340, and if it makes such complaint, the provisions of that section shali apply accordingly. (2) An order under this section and subject to any such order, an order under section 340, shall be final, and shall not be subject to revision. ” 8. In view of the Section 341 of CrPC., an order under Section 340 including refusing a complaint under sub-section (1) or sub-section (2) of Section 340 is appealable to the Court to which such former Court is subordinate. 9. In view of the statutory provision, this Court is not inclined to entertain this petition under Article 227 of Constitution of India. 10. The Civil Revision Petition is dismissed.
