Neutral Citation No. - 2025:AHC:51546-DB Court No. - 29 Case :- WRIT - C No. - 7622 of 2025 Petitioner :- Smt. Yashodhara Respondent :- Sachiv Uttar Pradesh Avas & Vikas Parishad 104 Mahatma Gandhi Marg, Lucknow And 4 Others Counsel for Petitioner :- Anupam Laloriya,Sushil Chaturvedi Counsel for Respondent :- Anand Prakash Paul,Ravi Anand Agarwal Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. 1. Limited grievance raised in the writ petition is that though Plot No. B-1/71 was allotted to petitioner by the respondent Kanpur Development Authority and a transfer deed was also executed on 29.7.2015, but the petitioner has not been handed over possession of such plot. It is also urged that in the event any dispute existed in respect of such land the Development Authority ought to have accommodated the petitioner in any suitable plot elsewhere. Since such claim of the petitioner has not been accorded consideration, the petitioner is before this Court. 2. Sri J.N. Maurya for the Kanpur Development Authority states that an alternative plot has been offered to the petitioner since various dispute exist in respect of the plot originally allotted to the petitioner. 3. Be that as it may, in the facts of the case, we are of the view that claim of the petitioner for delivery of possession of the plot originally allotted to her or for accommodating her in an alternative plot, if there existed any dispute, requires immediate consideration by the Kanpur Development Authority. This is particularly so as the petitioner has already paid amount and even after expiry of almost 10 years petitioner claims that possession has not been given to her. 4. In that view of the matter, we dispose of this writ petition with the direction to the Vice Chairman of the Kanpur Development Authority to accord consideration to the petitioner's claim and to pass an appropriate order in respect of her grievance within a period of four weeks from the date of presentation of a certified copy of this order. In the event the respondents propose to offer an alternative plot, they will intimate the petitioner of such offer and her views would be taken into consideration, while passing appropriate orders. 5.The writ petition, accordingly, stands disposed of.
