The petitioner has been made accused in connection with Daltonganj (Sadar) P.S. Case No. 74/2024, for the offences registered under Section 310(2) of the B.N.S., 2023, pending in the Court of learned C.J.M., Palamau at Daltonganj. On 23.08.2024, co-accused persons were apprehended while they had gone to a jewelry shop to sell jewelries, which were subject matter of a dacoity case. Mr. Rajendra Pd. Gupta, learned counsel for the petitioner submitted that petitioner is neither named in the F.I.R. nor anything was recovered from his possession. It was further submitted that the name of the petitioner has transpired in confession of co-accused Dharmendra Kumar. It was further submitted that similarly situated co-accused persons have been granted bail by this Court earlier. Learned A.P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Palamau at Daltonganj, in connection Daltonganj (Sadar) P.S.
