Case No. 66 of 2024 corresponding to POCSO Case No. 125 of 2024 for the offences registered under sections 64(2) (m) and 65(1) of the Bharatiya Nyaya Sanhita, 2023 and section 4 and 6 of POCSO Act, pending in the court of learned Special Judge, POCSO Act, Giridih. 3. Petitioner is alleged to have established consensual physical relationship with the prosecutrix who is a minor girl aged about 16 years. 4. Mr. A.K. Kashyap, learned senior counsel appearing on behalf of the petitioner, submitted that the parties were having affairs and they were in physical relationship since last one year. 5. Victim is a minor girl. Petitioner established consensual physical relationship with her when she was aged 15 years. Consent of the victim for physical relationship is immaterial. 6. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected. Learned Trial Court shall expedite the trial.
