Shukla, A.P.P ….... 08/02.07.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Section(s) 147, 148, 149, 302 IPC, Sections 25(1-B)A/26/27/35 of the Arms Act in connection with S.T. No. 239 of 2019 and 330 of 2020, pending in the Court of learned AJC, VII, Ranchi. 2 Heard the parties at length and had gone through the documents, annexed along with this application.
3. Opportunity was given to the State to oppose the bail, which the State availed and opposed.
4. There is allegation that the petitioners and others have committed murder of one Sonu Imroz. The police after investigation submitted final report exonerating the petitioners. The Trial of other accused proceeded and in that trial, an application under Section 319 Cr.P.C was filed, which was allowed and the petitioners were directed to face the trial. Thus these petitioners have filed this anticipatory bail application on the ground that now the warrant of arrest has been issued against them.
5. Since the petitioners have been arrayed as accused and have been directed to face the trial by invoking Section 319 Cr.P.C, I direct the petitioners to appear before the court concerned and they should face the trial. The petitioners will also file necessary bonds with undertaking that they will appear on each and every date during the trail, failing which, it will be open to the Court concerned to cancel their bail bonds and take appropriate steps against them.
6. Accordingly, this petition stands disposed of. Anu-CP-3
