02. 1. In view of the order in CRLMA No.25 of 2026, the ABLAPL is restored to file. 2. With the consent of learned counsel for the respective parties, the ABLAPL is taken up for hearing and orders. 3. Heard Mr. Panda, learned counsel for the petitioner and State. 4. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Brajarajnagar P.S. Case No.198 of 2025 corresponding to C.T. Case No.777 of 2025 pending in the file of learned J.M.F.C. (Cog. Taking), Jharsuguda on the grounds stated. 5. Perused the FIR as at Annexure-1. A case under Section 109 BNSS has been registered. Mr. Panda, learned counsel for the petitioner submits that two other accused persons are on
bail pursuant to the Court’s order in the ABLAPL Nos.12677 and 13273 of 2025. Mr. Panda, learned counsel would submit that three other accused persons have been granted bail and refers to Annexure-2. It is claimed that during the alleged incident, there was quarrel between both the sides and as a result, the assault was carried out allegedly by the accused persons named in the FIR i.e. Annexure-1. It is submitted to the Court that no one received any grievous injury as a result of the alleged assault. Recorded the objection of Mr. Panda, learned ASC for the State, who requests for an adjournment to collect the case diary and other police papers. It is informed to the Court that the chargesheet is filed in the meantime. From the FIR i.e. Annexure-1, the Court finds that the alleged occurrence took place on 1st September, 2025 during a festive occasion. As earlier stated, the co-accused persons, namely, Dinesh Kumbhar, Aman Barik and Sumit Bag are on bail so revealed from Annexure-2 and also two others by the ABLAPLs at Flag- A1 & A2. Considering the same and objection of the State, this Court instead of awaiting demanding production of police papers etc. is inclined to extend parity directing release of the petitioner upon his surrender before the learned court below with conditions. 6. Accordingly, it is ordered. 7. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C. (Cog.
Taking), Jharsuguda in connection with Brajarajnagar P.S. Case
No.198 of 2025 corresponding to C.T. Case No.777 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with other conditions imposed as deemed just and proper in the facts and circumstances of the case. 8.
