Dey, A.P.P. --- 03 / 21.01.2025 Heard the parties. 2. Petitioner has been made accused in connection with Pipratand P.S. Case No. 21 of 2024 for the offences registered under sections 80 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of Sri Nishikant, learned Judicial Magistrate, Palamau. 3. Petitioner is the husband of the deceased Shruti Devi who died due to poisoning in her matrimonial home. It is alleged that she was tortured by the accused persons to enforce the demand of dowry. 4. Statement of the independent witnesses namely Niranjan Kumar Gupta and Basant Kumar Gupta have been recorded under section 180 of the B.N.S in the case diary where both these witnesses have stated that on hearing commotion in the house of the petitioner, they went there where the deceased stated that she had consumed poison because there was some dispute over celebration of birthday of her two sons. They have also stated that the deceased wanted birthday of her two sons to be celebrated separately, but the family members were insisting that their birthdays will be celebrated together. 5. Mr. Arup Kumar Dey, learned A.P.P has opposed the prayer for bail, but does not dispute the aforesaid facts. 6. In view of the submission made above, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Sri Nishikant, learned Judicial Magistrate, Palamau or his successor in connection with Pipratand P.S.
