THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO: 2026/2025
ORDER:
This Contempt Case is filed against the respondents for willful disobedience of the orders dated 12.12.2023 passed by this Court in W.P.No.29808 of 2023.
2. The contempt case is filed after completion of the limitation period as contemplated under Section 20 of the Contempt of Courts Act, 1971. Admittedly, this Court passed an order on 12.12.2023 with the following direction:
“In view of the aforesaid directions of this Court in various cases and after hearing the submissions of
learned counsel for the petitioner, learned Government Pleader for Irrigation this Writ Petition is disposed of with a direction to the respondents to release the amount of Rs.10,66,111/- to the petitioner along with the interest @ 6% per annum, in view of the judgment of the Hon’ble Division Bench of this Court in Writ Appeal No.724 of 2021 and batch dated 12.10.2023, within a period of six (06) weeks from the date of receipt of a copy of this order. It would also be open to the petitioner to agitate his claim for higher rate of interest, if any payable by the respondents, in an appropriate forum. There shall be no order as to costs.”
3. The copy of the order dated 12.12.2023 was served on the respondents on 15.03.2024. In view of the same, the petitioner herein has to file contempt case on or before 15.03.2025, but the contempt case is filed on 31.08.2025. By

which Section 20 of the Contempt of Courts Act was not observed and the present contempt is filed after expiry of the limitation period.
4. Learned counsel for the petitioner sought permission of this Court to withdraw the Contempt Case.
5. Permission as sought for is accorded.
6. Accordingly, the Contempt Case is dismissed as withdrawn. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the contempt case shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J
