Heard Mr. S. Zaman, learned counsel for the applicant. Also heard Ms. V. Shoha, learned counsel appearing on behalf of Mr. J. Chutia, learned Standing Counsel, KAAC appearing for the respondents. Page No.# 3/3 By filing this application, the applicants seek to substitute herself and her two minor daughters in the connected writ petition being WP(C) 1595/2025 as the legal heirs on the death of the writ petitioner. The petitioner in the connected writ petition alleged that the myadi patta land has been forcefully taken over by the respondent authorities. During the pendency of the writ petition, the husband of the applicant had unfortunately expired. Under the circumstances, it is submitted that the applicant along with her two minor daughters being the legal heirs of late Birman Kholar be allowed to be substituted as petitioners in the connected writ petition. Ms.
V. Shoha, learned counsel for the respondent submits that she has no objection as the applicants appears to be the legal heirs of the petitioner late Birman Kholar. Having considered that the applicants are the wife and minor daughters of the petitioner late Birman Kholar in WP(C) 1595/2023, who has expired during the pendency of the connected writ petition, I am of the considered view that the applicants are entitled to be impleaded as petitioners in the connected writ petition by way of substitution. Accordingly, the applicants are allowed to be substituted as petitioners in place of the petitioner late Birman Kholar in WP(C) 1595/2023. I.A. stands allowed and disposed of.
