JUSTICE SANDEEP KUMAR ORAL ORDER 5 23-07-2025 Heard the learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 291 of 2024 registered for the offence under Sections 103, 238, 61(2), 3(5) of the BNS. 3. As per the prosecution case, the deceased Ankit Aditya was called by one Narendra Singh @ Fantoosh and others, thereafter, his dead body was recovered. During investigation, Narendra Singh @ Fantoosh was arrested and gave his self inculpatry statement from which it appears that Narendra Singh @ Fantoosh had planned the killing of the deceased. The petitioner and Narendra Singh @ Fantoosh and others went to the house of the deceased and called him and

Learned counsel for the petitioner submits that the petitioner petitioner is innocent and has falsely been implicated in this case. He further submits that except the confessional statement of accused Narendra Singh @ Fantoosh there is no material against the petitioner and similarly situated co-accused Prakash Kumar has already been granted bail by a coordinate Bench of this Court. Petitioner is in custody since 28.08.2024. 5. Learned counsel for the informant has vehemently opposed the prayer for bail and submitted that the petitioner is involved in killing of the deceased. He had accompanied Amit @ Lallu Kushwaha, Narendra Singh @ Fantoosh and others and the deceased was killed by them. From the self inculpatry statement of Narendra Singh @ Fantoosh, it appears that the other co-accused had decided to kill the deceased and for that they had gone to call him for a party. 6.
In para 150 of the case diary, it has come that the petitioner was at the place of occurrence and from the CDR, it has come that the petitioner was present at the place of occurrence is similar location and he has been in touch with with Amit @ Lallu Kushwaha on 24.08.2024. 6. Considering the aforesaid facts and circumstances and the materials available against the petitioner, I am not inclined to grant bail to the petitioner.
