This Writ Petition has been filed seeking to declare the action of respondents in seeking eviction of the petitioner from his land covered in R.S.No.201-1B, an extent of Ac.4.11 cents and R.S.No.202-2 an extent of Ac.4.31 cents situated at Kamayyapalem village, Jeelugumilli Mandal, Eluru District as illegal, arbitrary and contrary to the provisions of the Andhra Pradesh Scheduled Areas Land Transfer(APSALT) Regulation, 1959 (Regulation 1/1959) as amended by Regulation 1/1970, and consequently direct the respondents not to evict the petitioner from his land. 2. Case of the petitioner is that he is the owner and possessor of the agricultural land covered in R.S.No.201-1B, an extent of Ac.4.11 cents and R.S.No.202-2 an extent of Ac.4.31 cents situated at Kamayyapalem village, Jeelugumilli Mandal, Eluru District. The petitioner’s father acquired the land during his life time and after the death of his father, he came into possession and enjoyment of the schedule land. The petitioner obtained pattadar pass book and his name was also incorporated in the revenue records. SRK, J W.P.No.20175 of 2024

It is further stated that there is absolutely no kind of violation of the Regulation 1/1970 in respect of schedule land, but the respondents are seeking eviction of the petitioner from the schedule land. 4. The respondent No.5 filed counter affidavit stating inter alia that the respondents have not passed any orders for eviction of the petitioner from the subject land, since there is no complaint of violation of the APSALT Regulation 1959. The counter further reveals that all the allegations have been made by the petitioner without there being any comprehensive proof and the same are totally hypothetic. The averments in the counter affidavit are placed on record. 5. In view of the averments made by the respondent No.5 in the counter affidavit, this Court feels that no orders are necessary to be passed in the present Writ Petition. 6. Accordingly, the Writ Petition is closed. No order as to costs. 7. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
