Rakesh Kumar Vs. Sheela Devi CMP No. 8830 of 2024 in RSA No. 53 of 2016 13.3.2025 Present: Mr.Tarun Brakta, Advocate, vice Mr.Atharv Sharma, Advocate, for the applicant/appellant. Mr.Rohit, Advocate, for respondents No. 1, 3 and 6. Respondent No. 5 to 7 proceeded ex parte vide order dated 22.11.2024. None for respondent No. 4. CMP No. 8830 of 2024 Respondent No. 4 stands duly served for 5.8.2024, but he has not chosen to be represented, hence proceeded against ex parte. Steps for service of proposed respondents No. 2(a) to 2(d) be taken within one week, positively. Thereafter notice, to these proposed respondents be issued, returnable on next date. Process fee for service of respondents No. 8 and 9 is stated to have been filed on 25.11.2024, but necessary correction in terms of order dated 22.11.2024 has not been carried out by learned counsel in the memo of parties. Be carried out today itself in the Court. Thereafter notice to respondents No.8 and 9 be issued, returnable on next date. Corrected amended memo of parties filed on 26.11.2024 be taken on record. List for consideration on 28th May, 2025. CMP No. 25345 of 2024 This application has been filed for correction of parentage of respondents No. 8 and 9 in the memo of parties. In fact the correction has already been permitted to be carried out in the Court by the counsel under his signatures vide order dated 22.11.2024, but instead of carrying out correction in the memo of parties or filing corrected fresh memo of parties, this application has been filed after passing of order dated 22.11.2024. Therefore, this application has no merit and accordingly dismissed. (Vivek Singh Thakur), Judge. 13th March, 2025 (Keshav)
