This application has been filed by the petitioner for quashing of order dated 07.08.2024 passed by Sri Prem Shankar, learned Additional Sessions Judge-I-cum- Special Judge, Gumla in Misc. Criminal Application No. 156 of 2024, arising out of S.T. case No.157 of 2017, corresponding to Gumla P.S. Case No.129 of 2016 for offence under Section 376 of the I.P.C., whereby and wherein, the learned trial court has rejected the application filed by the petitioner under Section 311 of the Cr. P.C. It was submitted that the opposite party No.2 has compromised the case with the petitioner, after recording of her evidence. Application was filed for recall the victim for her further cross-examination on the point of compromise. Offence under Section 376 of the I.P.C. is non-compoundable. Accordingly, no case for recall of the victim for further cross-examination is made out. The learned trial court has rightly rejected the application of the petitioner under Section 311 Cr.P.C. This Cr.M.P. is dismissed. Pending I.A. if any, stands disposed of. (Ambuj Nath, J.) Jay/-
