Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus by declaring the Proceedings issued by the 1st Respondent in F.No.L- 52025/37/2014-IR (Imp-I), dated 18.09.2015 as illegal, arbitrary, opposed to the public policy and code of democracy adopted by the Constitution of India, consequently direct the Respondents to conduct elections for the verification of the recognized union in the 5th Respondent State Owned Company through Secret Ballot System by further declaring conducting elections through check off system is illegal, unconstitutional and violative of the fundamental rights guaranteed under the Constitution of India and contrary to the judgment of the Hon'ble Supreme Court in 1991 Supplementary 1 SCC 305. IA No.1 OF 2016 (WPMP 16284 OF 2016) Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the Respondents to conduct elections for verification process of the recognized union through Secret Ballot System in the 5th Respondent State Owned Company henceforth, pending disposal of the Writ Petition. Permission is accorded. Accordingly, the Writ Petition is dismissed as withdrawn. No order as to costs.
