Accused in Crime No.133/2025 registered by Parappana Agrahara Police Station, Bengaluru for offence punishable under Sections 69 of the Bharatiya Nyaya Sanhita (BNS), 2023 is before this Court under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.133/2025 was registered by Parappana Agrahara Police Station, Bengaluru, for the aforesaid offence against the petitioner herein based on the first information dated 05.05.2025 received from the victim lady aged about 30 years. Apprehending arrest in the case, the petitioner had filed Crl.Misc.No.4021/2025 before the Court of

the LIII Additional City Civil and Sessions Special Judge, Bengaluru, which was rejected on 29.05.2025. Therefore, he is before this Court. 5. Perusal of the averments found in the first information reveals that the victim is a married lady, aged about 30 years and her marriage was performed in the year
2017. Subsequently, in the year 2018, she got acquainted with the petitioner. She has stated that she fell in love with the petitioner and the petitioner had promised to marry her. She has not stated in her first information that her first marriage was dissolved. Therefore, the allegations found in the first information becomes doubtful. The petitioner has no criminal antecedents and he has undertaken to cooperate with the Investigation Officer for the purpose of investigation of the case. 7. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively reserving liberty to the Investigation Officer to take the petitioner into custody for the

purpose of interrogation by filing necessary application before the Trial Court, in the event it is absolutely necessary. Accordingly, the following order:-
8. The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.133/2025 registered by Parappana Agrahara Police Station, Bangalore for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita (BNS), 2023, subject to the following conditions:

The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 -

3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4. The petitioner shall not involve in similar offences in future;
