THE SENIOR DIVISIONAL SECURITY COMMISSIONER, RAILWAY PROTECTION FORCE SOUTH WESTERN RAILWAY KRANTIVEERA SONGOLLI RAYANNA RAILWAY STATION, BENGALURU - 560 023. …RESPONDENTS THIS WP IS FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECTION OR ORDER IN THE NATURE OF MANDAMUS BY FIXING A TIME FRAME TO DISPOSE OS NO. 6787/2022 PENDING ON THE FILE OF THE VII ADDL. CITY CIVIL AND SESSIONS JUDGE BENGALURU (CCH- 15) AND ETC., THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE M.NAGAPRASANNA ORAL ORDER Heard Smt. Sona Vakkund, learned counsel appearing for the petitioners and have perused the material on record. - 3 - HC-KAR NC: 2025:KHC:23087 WP No. 17300 of 2025 2. The petitioners-defendants are before this Court, seeking the following prayer: "i) Issue a writ direction or order in the nature of mandamus by fixing a time frame to dispose O.S.No.6787/2022 pending on the file of VIII Additional City Civil and Sessions Court Judge, Bengaluru (CCH-15) in the interest of justice and equity. ii) Issue direction to 3rd respondent, the railway authority to give job to petitioner subject to the result O.S.No.6787/2022. (iii) Issue any other writ, direction or order which deems it under the circumstances of the case." 3. The prayer is for an expeditious disposal of the suit. The suit is of the year 2022. The reason for projecting the said prayer is non-consideration of the case of the third petitioner for the purpose of appointment and compassionate grounds in the railways. It transpires that the father of the third petitioner and the husband of second petitioner died in harness while working in the railway protection force, after which, all the problems have cropped up, as there is a rival claimant, who are the plaintiffs, who have filed O.S.6787/2022 and have stalled the consideration of appointment on compassionate grounds of either the petitioners or themselves the respondents. - 4 - HC-KAR NC: 2025:KHC:23087 WP No. 17300 of 2025 3. In that light, in the peculiar circumstances, I deem it appropriate to direct the concerned Court to dispose the O.S.No.6787/2022 within an outer limit of six months, if not earlier. With the aforesaid observations, the petition stands disposed. Ordered accordingly. Sd/- (M.NAGAPRASANNA) JUDGE rv List No.: 2 Sl No.: 18 CT: BHK
