Heard learned counsel for the applicant, Sri V.P.Tripathi, learned A.G.A. for the State-opposite party, and perused the record. 3. This application under Section 482 BNSS has been filed seeking anticipatory bail in Case Crime No. 528 of 2021, under Sections 307, 323, 504 IPC, Police Station Kurawali, District Mainpuri. 4. Counsel for the applicant submits that on account of enmity the applicant has been falsely implicated in the instant case. The applicant has no criminal antecedents. Charge sheet has been submitted against the applicant. It is next contended that the applicant has apprehension of his arrest in the above mentioned case. 5. Learned AGA has opposed the prayer for anticipatory bail. 6. Having heard learned counsel for the parties and having perused the record, this Court prima facie finds that specific role of causing fire arm injury has been assigned to the applicant. As per the medical report, the injured sustained fire arm injury on his chest and shoulder. The statement of the informant-injured is supported by the medical report. In my opinion, this is not an appropriate case for grant of anticipatory bail. Hence the application is hereby rejected, leaving it open to the applicant to apply for regular bail before the concerned court, which application when filed, may be considered on its own merits, without being prejudiced by any observation made in this order.
