Petitioner has been made an accused in connection with S.T. Case No. 473/2024, arising out of Nirsa (Kalubathan O.P.) P.S. Case No. 170/2024, for the offence under sections 304-B/498-A/34 of the Indian Penal Code and sections 3/4 of D.P. Act and Charge-sheet has been submitted u/s 306 of I.P.C and on the same day cognizance of offence u/s 306 of I.P.C., pending in the court of learned Additional Sessions Judge-III, Dhanbad. Petitioner happens to be the husband of the deceased Bhadu Gorain who allegedly died because of asphyxia due to hanging in her matrimonial home. From the first information report, it appears that the deceased had sustained several mechanical injuries. Learned lawyer for the petitioner submitted that from the postmortem report, it will be apparent that the deceased had not sustained any mechanical injuries. The deceased died an unnatural death within 7 years of her marriage in her matrimonial home. Learned lawyer for the informant has vehemently opposed the prayer for bail and submitted that there is specific allegation that she was tortured to enforce the demand of dowry. Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected.
