In this writ petition, the petitioner has called in question the order dated 22.05.2025 passed by respondent No.1 vide Annexure-A, transferring respondent No.4 to petitioner’s place and the petitioner has been transferred to respondent No.4’s place. 2. The case of the petitioner is that he was appointed as a Bill Collector in the department of Respondent No.2 in the year 2003. Thereafter, he was promoted to the cadre of Revenue Officer in the year 2020 and was posted to Shivamogga. Subsequently, he was transferred to Birur in - 3 - HC-KAR NC: 2025:KHC:23638 WP No. 15849 of 2025 the year 2021 without completing his tenure of four years at the said place. Again, he was transferred to Kollegal in June 2023. Once more, by order dated 21.11.2023, he was transferred to Hosadurga Municipality as a Revenue Officer. Within a span of four years, the petitioner has been displaced nearly four times, without any stated reason and without any public interest. Thereafter, by impugned order dated 22.05.2025 vide Annexure-A, respondent No.4, who was working as Revenue Officer, Kadur, has been transferred to the petitioner’s present place and the petitioner has been transferred to respondent No.4’s place i.e. Kadur as Revenue Officer. Being aggrieved by the said order, the petitioner is before this Court. 3. The only ground urged by the petitioner is that he is a Group ‘C’ employee and as per the transfer guidelines, the tenure is for a period of four years. The petitioner took charge as Revenue Officer in Hosadurga Municipality on 07.12.2023. However, before completing his four years - 4 - HC-KAR NC: 2025:KHC:23638 WP No. 15849 of 2025 tenure, he has been transferred from Hosadurga by the impugned order vide Annexure-A. This transfer is made before the completion of the stipulated tenure and in violation of the transfer guidelines dated 12.05.2025. On this short ground alone, the impugned order vide Annexure-A is liable to be quashed as it is unsustainable in law. 4. Learned counsel for respondent No.4 at this stage submits that respondent No.4 has already been relieved from Kadur Municipality pursuant to impugned transfer order vide Annexure-A. 5. In view of the above, I pass the following order: ORDER a) The writ petition is allowed. b) The order dated 22.05.2025 passed by respondent No.1 vide Annexure-A, is quashed. - 5 - HC-KAR NC: 2025:KHC:23638 WP No. 15849 of 2025 c) Respondent No.4 is directed to take charge in Kadur Municipality as Revenue Officer.
