For Petitioner(s): Mr.S.C.Vishwanth For Respondent(s): Mr.M.Rajendran for R1 to R3 AGP O R D E R This Writ Petition is filed to direct the 2nd respondent to call for the records in impugned order Muu.Mu.4663/2019 / A4 dated 05/01/2021 and quash the same and consequently direct the 3rd respondent to cancel the Legal heir certificate issued in proceedings Pa.Mu. 1535 /2018 / E1, dated 15/06/2018 on the file of the 3rd respondent. 2.The case of the petitioner is that the petitioner's father, viz., Mungappa died on 16.01.2009 levaing his legalheirs, viz., his wife and the petitioners, who are son and daughtes respectively. Subsequently, the petitioners applied 2/6 https://www.mhc.tn.gov.in/judis WP No. 8976 of 2021 for death certificate and legalheirship certificate and obtained the same from Tahsildar, Hosur on 30.09.2012. The petitioners' family had a land dispute, for which O.S. No.148 of 2009 is pending on the file of Disrict Munsif Court, Hosur, while so, the 5 th respondent claim to be son of the Petitioner's father, Murugappa, who is the resident of Nagapally village had wrongly obtained legalheirship certificate along with his family members, aggrieved by the same, the petitioner made a representation to the respondents 1 to 3 for cancellation of legalheir certiciate vide representation dated 06.11.2019. The 2 nd respondent, vide its impugned order dated 05.01.2021 cancelled all the certificates and directed the Tahsildar to conduct a fresh enquiry and issue a fresh certifiate to the legal and eligible persons, challenging the same, the present writ petition is filed. 3. It is the contention of the learned counsel for the petitioners that though the petitioner filed the present Writ petition with the aforesaid prayer, challenging impugned order dated 05.01.2021, the petitioner seeks a direction to produce all the documents before the 3 rd respondent / Tahsildar and inturn, the 3 rd respondent may be directed to conduct the enquiry and to 3/6 https://www.mhc.tn.gov.in/judis WP No. 8976 of 2021 issue a legal heirship certificate to the legally eligible persons of the deceased, Mungappa, for which the learned Additional Government Pleader for the respondents has no serious objection, however, pleaded to grant sufficient time to consider the same. 4. Considering the facts and circumstances of the case and the submissions made by the learned counsel appearing for the petitioners, this Court without interfering with the impugned order, hereby directs the petitioner to submit all the relevant documents to substantiate their claim along with a copy of this order to the 3 rd respondent and the 3 rd respondent is directed to conduct a detailed enquiry and issue a legal heirship certificate to the legally entitled persons. 5. With the above directions, the petition is disposed of .
