HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU
WP(C) PIL No. 3/2021
Rajmohinder Singh ..... appellant (s)
Through :- None
V/s
UT of Jammu and Kashmir and others .....Respondent(s)
Through :- Mr. S.S.Nanda Sr. AAG
Coram: HON’BLE THE ACTING CHIEF JUSTICE
HON’BLE MR. JUSTICE M.A.CHOWDHARY, JUDGE
ORDER
On the last four occasions, there has been no representation on behalf of the petitioner, who has filed this petition purportedly in public interest.
We have gone through the petition, in which, in the name of environmental concerns, the mining leases issued by respondent No.3 in favour of the private respondents have been called in question.
Be that as it may, as already observed by this Court on 09.04.2021, the concerns voiced by the petitioner can be appropriately addressed before the National Green Tribunal, which has been constituted for dealing with environmental issues. Moreover, since the petitioner has remained on the back foot ever since a query was put to him on 09.04.2021, and has now even stopped appearing in the matter to assist this court, we deem it appropriate not to keep this petition pending unnecessarily.
Sr. No. 14
2
Accordingly, the petition is dismissed and the proceedings are closed. However, the petitioner is at liberty to approach the National Green Tribunal if he has any grievance with regard to environmental degradation due to the grant of mining leases etc.
