ORDER Date : 26-11-2025 This contempt petition had been instituted alleging non-compliance of the
order dated 09.09.2024 passed in WP(C) No. 4399/2024 whereby the following was required to be done;

“3. The petitioner herein would be at liberty to approach the Competent Authority if the petitioner is aggrieved by the inadequacy of the compensation and upon such approach, the Competent Authority is directed to make the reference to the Arbitrator within 15 (fifteen) days from the date of the said representation.”
The learned counsel for the petitioner has submitted that the petitioner had approached the competent authority raising the grievances of inadequacy of the compensation. Although, it was alleged in the contempt petition, the competent authority had not taken appropriate steps for making reference to the arbitrator. Mr. S. Dutta, learned counsel for the sole respondent submits that he is under instruction by communication dated 24.10.2025, that the matter has been referred to the Arbitrator-cum-Secretary, Government of Assam, Revenue & D.M Department, Assam. On such submission, the learned counsel for the petitioner submits that by forwarding the application to the arbitrator, the order is substantially complied with has been carried out. In view of the submission made, this contempt petition is closed as substantial compliance of the order passed in the writ petition. A copy of the communication dated 24.10.2025 is kept on record and marked as Annexure-X
