This is an application under Section 483 of the BNSS, 2023 praying bail for the accused Manuj Bordoloi who was taken into custody on 26.03.2025 under PRC Case No. 250/2025, in connection with Nagaon P.S Case No. 1304/2022 under Section 341/302/34 of I.P.C, which is pending in the Court of Addl. District & Sessions Judge No. 2, Nagaon, Assam. 4. As per the FIR, it is stated inter alia that informant's son Kalyan Jyoti Saikia (33 years), S/o Late Putukon Saikia, and one Girish Nath (38 years), S/o Dulan Chandra Nath, both R/o of Vill. Senchowa under Sadar Police Station in the District of Nagaon, Assam went to view Raash Utsav in the premises of Senchowa Amar Borkakati High School on 08/11/2022 at around 9:30 PM. During that time there was an altercation with the F.I.R. named accused persons (1. Manoj Bordoloi, S/o Kaurna Bordoloi, 2. Papumoni Kakati, S/o Bipul Kakati,
3. Papu Das, S/o Nila Das, all of Vill. Snechowa Matakgaon under Sadar P.S., Anagaon, Assam). Thereafter, the F.I.R. named Accused No.1 knocked down the son of the informant to ground by riding a Pulser Bike in high speed near Haldhiati PNB Godown with intent to kill him at around 12-30 in the night while they were coming home. At that time Accused No.2 & 3 also came to the place of occurrence on a scooty and all the three accused persons had ridden the bike over the informant's son causing leg and head injury. Accused No.2 had punched the right eye of the victim with the help of key of the scooty.
Said Girish Nath was also assaulted by the Accused No.1 and 3 when he tried to resist and then the Accused No.2 tried to press on his neck. He somehow fled away and informed his elder brother Pranab Nath over phone and said Pranab Nath reached the place of occurrence and took the informant's son to Dew Care Hospital. In view grievous injury sustained by the informant's son, he was sent to GMCH and he died next day at around 6-30 AM during medical treatment. In
Page No.# 3/3 the FIR, it was also noted that there was some delay in lodging the FIR in view of last rites of the deceased and though Police went there on the day of death, but did neither interrogate nor inspected the place of occurrence. 5. Upon perusal of the record, it appears that there is sufficient and direct incriminating material as regards the role played by the accused petitioner which caused the death to the deceased. 6. Having regard to the gravity of the offence and the material against the petitioner, the prayer for bail stands rejected and the petition is dismissed. JUDGE Comparing Assistant
