Sri Bhupendra Kumar Pandey, learned counsel for the applicant, Sri Rajnish Tiwari, learned counsel for the private opposite party no.2 and Sri Tejbhan Singh, learned A.G.A. for the State are present. The present application u/s 528 of BNSS of 2023 has been filed with prayer to issue a direction to the opposite party nos. 2 and 3, Commissioner of Police, District Prayagraj and Station House Office , P. S. Koraon, Allahabad respectively to comply the order dated 11.02.2025 passed in Case No. 969 of 1999 (State vs. Ram Chandra Jsaisal and others), arising out of Case Crime No. 60 of 1992, under Sections 420, 467, 468, 471, 409 and 120B IPC, P.S. Koraon, District Allahabad, whereby exemption application of the accused has been allowed. Learned counsel for the applicant submits that present applicant is an affected party. Learned counsel for the applicant fairly submits that the FIR has been lodged by the Sub-Divisional Magistrate. After some arguments, learned counsel for the applicants does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicants after retaining a photocopy of the same.
