The National Insurance Company Ltd. is represented by its duly authorized officials, namely, Mr. P. D. Bhutia, Regional Manager and Debajit Sarkar, Assistant Manager. The Claimant, namely, Kabita Shil Sharma @ Kabita Sutradhar, is present in person, along with her engaged counsel, Mr. A. R. Agarwala. It is submitted that the awarded amount was Rs. 6,50,000/- (Rupees Six Lakh Fifty Thousand Only). After negotiations, both parties have Page No.# 3/3 mutually agreed to settle the matter for a sum of Rs. 9,80,000/- (Rupees Nine Lakh Eighty Thousand Only) as full and final settlement of the claim, of which Rs. 6,50,000/- (Rupees Six Lakh Fifty Thousand Only) has already been paid and the remaining additional amount of Rs. 3,30,000/- (Rupees Three Lakh Thirty Thousand Only) is to be paid. Accordingly, The National Insurance Company Ltd. is hereby directed to deposit the sum of Rs. 3,30,000/- (Rupees Three Lakh Thirty Thousand Only) before the Registry of this Court, within one month from the date of this order. Consequently, out of the sum of Rs. 3,30,000/- (Rupees Three Lakh Thirty Thousand Only), Rs. 50,000/- (Rupees Fifty Thousand Only) each shall be deposited in a nationalised bank for the minor son, Banaru Sutradhar and the minor daughter, Archana Sutradhar, to be held in their names until they attain majority. The remaining balance of Rs. 2,30,000/- (Rupees Two Lakh Thirty Thousand Only) shall be released to the mother, Kabita Shil Sharma @ Kabita Sutradhar. The Claimant, namely, Kabita Shil Sharma @ Kabita Sutradhar, is permitted to withdraw her share of the deposited amount upon proper verification and identification. The appeal stands disposed of in terms above. JUDGE Comparing Assistant
