2. This petition has been filed under Section 528 of the Bharatiya Nagrik Suraksha Sanhita(BNSS), 2023, seeking quashing of the criminal proceeding under G.R. C/No. 149/2023 against the petitioner.
3. During the pendency of the petition, the petitioner has expired on 12.01.2026. In view thereof, the learned counsel for the petitioner prays for permission to withdraw the petition.
4. In view of the death of the petitioner, the cause of action does not survive and the petition has become infructuous. Accordingly, the prayer for withdrawal of the petition, is hereby allowed.
5. The instant criminal petition, accordingly, stands dismissed as withdrawn/infructuous.
