The suit filed by plaintiff was decreed against which no further appeal was filed, which has been stated in para no. 7 of writ petition. An Execution Case No. 9 of 2002 was filed which was dismissed for want of prosecution in which a Restoration Application No. 13 of 2022 has been filed which is pending consideration. The sole prayer made is for expeditious disposal of the restoration application. 2. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon court concerned to decide the Restoration Application No. 13 of 2022 filed in Execution Case No. 9 of 2002 arising out of Civil Suit No. 514 of 1982, in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. 3. With the aforesaid directions, writ petition stands disposed of. 4. It is made clear that this Court has not adjudicated the matter on merits.
