Mattegunta.Sudhir, Standing Counsel For Z.P.Ps,M.P.Ps,Gram Panchayats The Court made the following order: 2 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION NO.20091 of 2024 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate Writ or Order or direction more particularly one in the nature of Writ of Mandamus declaring the action, things and deeds of Respondents in not paying the contract bill amount to the Petitioner i.e., Rs.5,83,765/- (Rupees Five Lakhs Eighty Three Thousand Seven Hundred and Sixty Five Only) in respect of the works executed by the Petitioner i.e., Repairs to the MGNREGS Buiiding at Sattenapalli, Improvement to the MPDO Office Premises at Sattenapalli and Improvement to the MPDO Office Building at Sattenapalli, which is illegal, irregular, arbitrary, unconstitutional, against to the Principles of Natural Justice and in violation of Articles 14 and 21 of the Constitution of India, consequently direct the Respondents to pay the total contract bill amount of Rs.5,83,765/- (Rupees Five Lakhs Eighty Three Thousand Seven Hundred and Sixty Five Only) along with interest for the works carried by the Petitioner and to pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.” 2. Heard learned counsel for the petitioner and learned counsel for the respondents. 3. The 4th respondent filed counter and in para No.4, it is stated that they are going to pay the amount to the petitioner within three months with the approval of mandal parishad resolution basing on the available funds. 4. As per the counter affidavit, the respondents are not disputing the work executed by the petitioner and the amount payable to the petitioner and only sought three months time to pay amount to the petitioner. Hence, this Court is inclined to dispose of this writ petition 3 directing the respondents to pay the admitted amount payable to the petitioner within a period of three months from today, failing which, the petitioner is entitled to claim interest @ 9% per annum from the date of writ petition till the date of realization. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
