Leela Srinivasa Varma, Ld. Counsel for the Writ Petitioner in W.P.No.12218 of 2019 and Sri Bala Mohan Ranga, Ld. Counsel for the Writ Petitioner in W.P.No.18940 of 2019 and Sri N.V.S. Prasad Varma, Ld. Standing Counsel for the T.T.D. 2. The facts in W.P.No.12218 of 2019 would indicate that one Sri T. Nagi Reddy was allotted a shop in the TTD Complex bearing shop No.349 near Mokalla Mitta (Near new Mandapam) on humanitarian grounds. Sri T. Nagi Reddy had four sons and one daughter. While the shop was being run by Sri T. Nagi Reddy, the first son by name Sri Madan Mohan Reddy had predeceased Sri T. Nagi Reddy (father) on 03.02.2016. On the date of his death, the deceased Sri Madan Mohan Reddy was survived by wife viz., Smt. T. Sangeeta and two minor children. The family was looked after by Sri T. Nagi Reddy. 3. Sri T. Nagi Reddy who is the original allottee had died on 28.04.2019. The widow of Sri Madan Mohan Reddy i.e., Smt. T. Sangeeta has filed O.S.No.573 of 2019 against the Tirumala Tirupati Devastanam (TTD) seeking to declare herself and their two minor sons as Legal Representatives of late Sri T. Madan Mohan Reddy, who is the son of Sri T. Nagi Reddy (original licensee). She has also made an Application before the Tirumala Tirupati Devastanam (TTD) for allotment of shop No.349 which was earlier allotted to her father-in-law. On 07.08.2019, the Tirumala Tirupati Devastanam (TTD) has rejected the request of Smt. T. Sangeeta (Ex.P.14), thereby, terminating the license granted in favour of Sri T. Nagi Reddy. Subsequently, the case of the Smt. T. Sangeeta was referred to the Estate Committee for fresh consideration. The Estate Committee, after having considered the case of Smt. T. Sangeeta, had allotted the said shop in her favour temporarily on humanitarian grounds till the outcome in W.P.No.12218 of 2019. This Writ Petition is also being now taken up. 4 4. The Writ Petitioner in W.P.no.18940 of 2019 is placing reliance on the alleged Registered Will dated 14.10.2010. It is also stated that the O.S.No.573 of 2019 is also pending on the file of the Principal Civil Judge (Junior Division), Tirupati for final adjudication. 5. Insofar as the impugned Proceeding of the Tirumala Tirupati Devastanam (TTD) dated 04.11.2019, by which the shop had been temporarily allotted to Smt. T. Sangeeta on humanitarian grounds is concerned, this Court is of the opinion that the humanitarian view taken by the Tirumala Tirupati Devastanam (TTD) cannot be faulted. 6. In this view of the matter, Smt. T. Sangeeta (Writ Petitioner in W.P.No.12218 of 2019) shall be allowed to continue to operate the shop on temporary basis till the conclusion of the O.S.No.573 of 2019, which is pending on the file of Principal Civil Judge (Junior Division), Tirupati. As indicated above, W.P.No.12218 of 2019 is disposed of. 7. Insofar as the W.P.No.18940 of 2014 is concerned, since this Court has already opined that the decision taken by the Tirumala Tirupati Devastanam (TTD) to temporarily allot the shop in favour of Smt. T. Sangeeta cannot be faulted, this Writ Petition is accordingly dismissed. No order as to costs. 8. Accordingly, W.P.No.12218 of 2019 is disposed of in terms of what is stated above and W.P.No.18940 of 2014 is dismissed. No order as to costs in both the Writ Petitions. 9.
