In the instant case, the transaction is ab initio void, that is, right from its inception and is not voidable at the volition by virtue of the specific language used in Section 42 of the Rajasthan Tenancy Act. There is declaration that such transaction of sale of holding "shall be void". As the provision is declaratory, no further declaration is required to declare prohibited transaction a nullity. No right accrues to a person on the basis of such a transaction. The person who enters into an agreement to purchase the same, is aware of the consequences of the provision carved out in order to protect weaker sections of Scheduled Castes and Scheduled Tribes. The right to claim compensation accrues from right, title or interest in the land. When such right, title or interest in land is inalienable to non-SC/ST, obviously the agreements entered into by the Society with the Khatedars are clearly void and decrees obtained on the basis of the agreement are violative of the mandate of Section 42 of the Rajasthan Tenancy Act and are a nullity. Such a prohibited transaction opposed to public policy, cannot be enforced. Any other interpretation would be defeasive of the very intent and protection carved out Under Section 42 as per the mandate of Article 46 of the Constitution, in favour of the poor castes and downtrodden persons, included in the Schedules to Articles 341 and 342 of the Constitution of India." blh izdkj fo}ku vf/koDrk izfroknh Øe&1 dh vksj ls izLrqr vU; fu.kZ; Banwari Lal Vs. Section 42 (b) of the Act provides that the sale, gift or bequest by a khatedar tenant shall be void, if such sale, gift or bequest is by a member of scheduled caste in favour of a person who is not a member of scheduled caste, or by a member of scheduled tribe in favour of a person who is not a member of scheduled tribe. Meaning thereby, a member of scheduled caste may transfer his interest in whole or a part of his holding only to the member of the scheduled caste and a member of scheduled tribe may to a member of the scheduled tribe only. The emphasis of Section 42 is to maintain rights of a member of scheduled caste/scheduled tribe in their own category. The transferee should be a member of scheduled caste, if the transferor is from scheduled caste, and same will be the position in the caste of scheduled tribe also. As a matter of fact Section 42 does not permit transfer of interest in a land holding by a member of scheduled caste/scheduled tribe even to a person who is not having any caste. The sole emphasis of the provisions of Section 42 is to protect scheduled castes and scheduled tribes from social injustice and to ensure their economic rights. For this purpose land holding rights of these sections are kept intact in their own category. [2025:RJ-JP:40073] (7 of 15) [CR-198/2023] 18. Thus, it is clear that even for a suit for specific performance to be maintained it is essential that the contract or agreement, upon which the suit is based, should be valid and enforceable in law and if it suffers from some defect which makes it invalid or enforceable, the suit cannot be maintained. 19. In the present case, the agreement to sell dated 10.5.2002 said to be executed by the petitioner a member of scheduled caste, in favour of the non-petitioners members of general class, is void and forbidden by law being made in contravention of Section 42 (b) of the Act and provisions of Section 23 of the Indian Contract Act, even a suit for specific performance cannot be maintained upon it. The learned Court below without considering the matter in a right perspective has dismissed the application filed by the petitioner under Order 7 Rule 11 CPC only by finding that the question raised is a mixed question of fact and law which can be decided only after recording the evidence of the parties. Order 7 Rule 11 CPC provides that if from the averments made in the plaint the suit appears to be barred by law, the plaint would be liable to be rejected. The net result of the above discussion is that the revision petition is liable to be allowed and as a consequence of that the application filed under Order 7 Rule 11 CPC is also liable to be allowed and the plaint filed by the non- petitioners is required to be rejected." blds foijhr fo}ku vf/koDrk oknh dk rdZ gS fd vf/kfu;e&1955 dh /kkjk 42ch ds izko/kku foØ;] migkj o olh;r ds ekeys esa ykxw gksrs gSa] tcfd orZeku ekeys esa ek= foØ; vuqca/k gh fu"ikfnr gqvk gS rFkk okn izLrqfr ds le; ;g Hkwfe vkoklh; iz;kstukFkZ :ikarfjr gks pqdh gS] vr% ,slh fLFkfr esa [2025:RJ-JP:40073] (8 of 15) [CR-198/2023] ;g okn iks"k.kh; gS rFkk fo}ku fopkj.k U;k;ky; }kjk ikfjr vk{ksfir vkns'k dks rF;ksa o fof/k ds vuq:i gksuk crkrs gq, ;g fuxjkuh ;kfpdk [kkfjt fd;s tkus dk fuosnu fd;kA /kkjk 42ch jktLFkku dk'rdkjh vf/kfu;e] 1955 ds lqlaxr izko/kku fuEukuqlkj gSa%& "42. Having carefully considered the submissions made by the learned Senior Counsel for the parties and having examined the law laid down by the Constitution Benches in the abovesaid decisions, we would like to sum up the legal position in the following terms: (1) The law laid down by this Court in a decision delivered by a Bench of larger strength is binding on any subsequent Bench of lesser or coequal strength. [2025:RJ-JP:40073] (11 of 15) [CR-198/2023] (2) A Bench of lesser quorum cannot disagree or dissent from the view of the law taken by a Bench of larger quorum. In case of doubt all that the Bench of lesser quorum can do is to invite the attention of the Chief Justice and request for the matter being placed for hearing before a Bench of larger quorum than the Bench whose decision has come up for consideration. It will be open only for a Bench of coequal strength to express an opinion doubting the correctness of the view taken by the earlier Bench of coequal strength, whereupon the matter may be placed for hearing before a Bench consisting of a quorum larger than the one which pronounced the decision laying down the law the correctness of which is doubted. (3) The above rules are subject to two exceptions: (i) the abovesaid rules do not bind the discretion of the Chief Justice in whom vests the power of framing the roster and who can direct any particular matter to be placed for hearing before any particular Bench of any strength; and (ii) in spite of the rules laid down hereinabove, if the matter has already come up for hearing before a Bench of larger quorum and that Bench itself feels that the view of the law taken by a Bench of lesser quorum, which view is in doubt, needs correction or reconsideration then by way of exception (and not as a rule) and for reasons given by it, it may proceed to hear the case and examine the correctness of the previous decision in question dispensing with the need of a specific reference or the order of the Chief Justice constituting the Bench and such listing.
