CRIMINAL PETITION NO. 206 OF 2025
ORDER:
This Criminal Petition, under Sections 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking anticipatory bail, in Crime No.90/2024 of Chinturu Police Station, Alluri Seetharamaraju district.
2. A case has been registered against the petitioner herein and another for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
3. Case of the prosecution in brief is that on 04.12.2024, at about 07.15 pm, the Sub-Inspector of Police, Chinturu Police Station, on receipt of credible information about illegal possession and transportation of ganja, secured the presence of mediators and conducted vehicle checking opposite to Chintur police station. They found one white colour Bolero vehicle bearing registration no.AP 26 AG 8788 coming from Sileru. On seeing police, the inmates in the car tried to skulk away. Then police apprehended A1 while A2 escaped. On interrogation, A1 disclosed his identity particulars and police seized 82 kgs of ganja in the car. Police arrested A1 on the same day and got

remanded to judicial custody. On his confession, the name of the petitioner was added in the F.I.R.
4. Heard. Perused the record.
5. Learned Assistant Public Prosecutor submits that the investigation is at nascent stage and A2 is absconding from the scene of offence.
6. A perusal of the material on record goes to show that the police have seized 82 Kgs of Ganja from the possession of A1. On the confession of the A1, the name of the petitioner was added in the F.I.R. Since the seized contraband is of huge quantity and that too as the accused was absconding from the scene of offence, this Court is not inclined to grant anticipatory bail to the petitioner/A2.
7. Accordingly, the Criminal Petition is dismissed.
