This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner through Virtual High Court, Angul and learned counsel for the State. This is an application for bail under section 483 of the B.N.S.S., 2023 in connection with Sector-15 P.S. Case No.182 of 2024 corresponding to G.R. Case No.3360 of 2024 pending before the learned Court of the Additional C.J.M., Rourkela for alleged commission of offence under sections 419/420/465/ 467/471/120-B/34 of the Indian Penal Code read with sections 66(C)/66(D) of the I.t. Act. The prayer for bail of the petitioner was rejected by the learned 2nd Additional Sessions Judge, Rourkela vide order dated 03.04.2025. Considering the submission made by the learned counsel for the petitioner that the petitioner, who was an agent of MVC Company and is in judicial custody since 10.12.2024 and the offences are triable by Magistrate and similarly situated co- accused, namely, Umesh Kumar Ramani has been granted bail, which would be evident from Annexure-3 and after hearing the learned counsel for the State, I am inclined to release the petitioner on bail. Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court below may deem just and proper including the conditions that the petitioner shall not indulge in any criminal activities and shall appear before the learned trial Court on each date to which the case would be posted for trial. Violation of any of the conditions shall entail cancellation of bail. The BLAPL is disposed of accordingly. Issue urgent certified copy as per Rules. (S.K. Sahoo) Judge Basu
