Heard learned counsel for the petitioner, learned ASGI for the respondent No.1, Sri Devi Shanker Shukla, learned counsel for the respondents No.2 to 4 and learned Standing Counsel for the respondent No.5. 2. The petitioner by means of the present writ petition has assailed the order dated 19.12.2024 by which the candidature of the petitioner for allotment of the petrol pump in village Pakriyar has been rejected on the ground that the petitioner has submitted Khatauni of village Pakriyar Vishunpur and not Pakriyar. 3. Sri Devi Shanker Shukla, learned counsel for the respondents No.2 to 4 has contended that in fact there is defect in the advertisement inasmuch there is no village Pakriyar and therefore, the Corporation is not proceeding for making any allotment of the petrol pump. 4. Paragraph No.4 of the short counter affidavit filed by the State reads as under:- "That in fact, the said road passes through a village known as "Parkadiyar Vishunpur" which is recorded in official Versus Counsel for Petitioner(s) : Ashutosh Kumar Gautam, Santosh Kumar Tiwari Counsel for Respondent(s) : A.S.G.I., Devi Shanker Shukla, Gaurav Kumar Chand Arjun Kharwar .....Petitioner(s) Union Of India And 3 Others .....Respondent(s) revenue records as Village Cole No.184615." 5. In view of the statement made by learned counsel for the Corporation, no cause of action survives in the writ petition. 6. Accordingly, the writ petition is dismissed as infructuous.
