GP FOR HOME The Court made the following ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent No 4 in interfering into the civil disputes between the petitioner and the 5th respondent in respect of the suit scheduled properties in O.S.No.98 of 2016 on the file of the Junior Civil Judge Madakasira is illegal arbitrary and lack of jurisdiction and 2 consequently direct the respondents not to interfere in to civil disputes in relating to the suit schedule properties in O.S.No.98 of 2016 on the file of the Junior Civil Judge Madakasira” 2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that there are civil disputes between the parties and the Police are not interfering with the civil disputes. Hence, the petition may be disposed of. 4. For ready reference, the written instructions are extracted hereunder: “I further submit that the matter appears to be purely civil in nature and no criminal aspect is involved warranting police interference. As such, this police station has not initiated any inquiry, investigation, or taken any coercive steps against the petitioners.” 5. Learned counsel for the Petitioner would submit that the court may pass appropriate orders. 6. Considering the submissions made, the Writ Petition is disposed of. However, the police are directed not to interfere with the civil disputes pending between both the parties. There shall be no order as to costs.
