Vivek Singh Thakur, Judge (Oral) Present petition has been filed against the order dated 07.11.2024 passed by learned Rent Controller-III, Shimla in Case No. 86/18 titled Rajput Sthaniya Sabha vs. Naresh Sharma, whereby application filed by petitioner under Order 8 Rule 9 CPC has been dismissed. 2 In response to offer made by learned counsel for respondent on previous date, learned counsel for petitioner has positive instructions to dispose of the petition with direction to the Rent Controller to expedite the hearing as per seniority of the case and make an endeavour to decide the case in a time bound manner with further request to impose lesser cost than Rs.20,000/-. ( 2025:HHC:5591 ) 3 As parties have agreed for expediting the hearing being an old matter before the Rent Controller, present petition is disposed of by granting one opportunity to the petitioner/tenant to file sur-rejoinder as prayed subject to payment of cost of Rs.10,000/- payable to the respondent/landlord well before next date of hearing fixed by this Court in this order. 4 Sur-rejoinder shall also be presented on the first date before the Rent Controller, failing which right to file sur-rejoinder shall stand closed. Parties are directed to appear before the Rent Controller on 24th March, 2025 and thereafter, the Rent Controller shall proceed further in terms of aforesaid order and shall adjudicate the matter thereafter in accordance with law as expeditiously as possible in a time bound manner in terms of H.P. High Court of Himachal Pradesh Case Flow Management (Subordinate Courts), Rules, 2005 as well as seniority of the case. Petition is allowed and disposed of in aforesaid terms along with all pending miscellaneous application(s), if any. Interim order stands vacated. (Vivek Singh Thakur), 11th March, 2025 Judge. (MS) 2
