Bhag Chand Vs. Himachal Pradesh State Forest Development Corporation Ltd. and Ors. Execution Petition No.6 of 2025 Item No.D-10 21.05.2026 Present: Mr. Yudhvir Singh Thakur, Advocate, for the applicant/petitioner. Mr. Vijay Kumar Arora, Senior Advocate with Mr. Gaurav Kumar, Advocate, for the respondents-Corporation. CMP No.10957 of 2026 Application has been filed by the applicant for the release of arrears deposited in the Registry of this Court. Vide order dated 02.09.2025, the Managing Director of the respondents/Corporation was directed to remain present in the Court, as the order dated 01.07.2025, had not been complied with. On 07.10.2025, a demand draft of Rs.5,83,160/- was produced in favour of the Registrar General. On the said date, learned counsel for the respondents/Corporation apprised the fact that the operation and execution of order dated 01.07.2025, presence of the Managing Director, was stayed by the Apex Court in SLP(C) No.26610/25. Resultantly, we adjourned the execution petition sine die with liberty to file an appropriate application after disposal of the matter. From a perusal of the application, it is evident that SLP was dismissed vide order dated 09.01.2026 (Annexure A-1). The said order reads as under:- “As the High Court is still seized of the contempt proceedings, we find no reasons to entertain this special leave petition at this stage. It is for the petitioners to answer the allegation of being in contempt before the High Court. The special leave petition is, accordingly, dismissed. Pending application(s), if any, shall stand disposed of.” Since we are only ensuring the compliance of the order dated 01.07.2025, therefore, no further orders are required to be passed in the Execution Petition and the applicant is entitled to the release of the said amount. No reply is intended to be filed on behalf of the non-applicant. Non-applicant has no objection, if in case, the present application is allowed and the amount lying deposited in the Registry of this Court, is ordered to be released in favour of the applicant. Other than the aforesaid, for the reasons mentioned in the application, the same is allowed and the amount lying deposited in the Registry of this Court is ordered to be released in favour of the applicant along with upto date interest accrued thereupon. The same be remitted to the bank account of the applicant, details whereof have been given in para 15 of the application, subject to proper verification of his identity. Liberty is granted to the applicant to take out appropriate proceedings, in case any grievance is left with respect to the interest portion. Application stands disposed of (G.S.
