Petitioner has been made an accused in connection with S.T. Case No. 423/2024, arising out of Kadma P.S. Case No. 104/2024, Corresponding to G. R. Case No. 779/2024, registered under Section 376 of the Indian Penal Code, pending in the Court of learned District & Additional Sessions Judge-VII-Cum-F.T.C.-Spl. Court, CAW, Jamshedpur. On 08.06.2024, the petitioner is alleged to have raped the prosecutrix. It further appears that on 14.06.2024 again, he came to the house of the informant and raped her. Learned lawyer for the petitioner submitted that there is delay in lodging of the FIR. It was further submitted that the parties were in consensual physical relationship. It was further submitted that the prosecutrix was also in touch with the petitioner on WhatsApp. Learned lawyer for the informant has opposed the prayer for bail and submitted that the victim has supported the allegation in her statement recorded under section 183 BNSS. She has also stated that the petitioner from jail custody is threatening the victim to become hostile. Regard being had to the facts and circumstance of the case and considering the nature of allegation; I am not inclined to enlarge the petitioner on bail.
