ORDER: The writ petition is filed aggrieved by the action of the respondents in not incorporating of the name of the petitioner in Jagananna Bhu Hakku Survey/RegisterA/Vebland Register, despite the name of the petitioner was incorporated in the revenue records under the provisions of A.P. Rights in Land and Pattadar Pass Book Act, 1971, even the petitioner has submitted several representations, out of one which is 20.11.2023. 1 Learned Assistant Government Pleader for Revenue submitted that the competent authority has power under section 9 of the A.P.Survey and Boundaries Act, 1923 to decide the dispute and determine the boundary, which reads as follows;
2. 9.Power of survey officer to determine and record an undisputed boundary (1)The survey officer shall have power to determine and record as undisputed any boundary in respect of which no dispute is brought to his notice. (2) Notice to registered holders of land affected:- Notice of every decision of the survey officer under Section 9 (1) shall be given in the prescribed manner to the registered holders of the lands the boundaries of which may be affected by the decisions. Since, all the powers are vested with the respondent authorities, this court directs the respondents to consider and dispose of the representation dated 20.11.2023 in accordance with law and communicate the said decision to the petitioner within a period of six (06) weeks from the date of receipt of a copy of this order.
